Terms and conditions

Kidsnest will provide the Services at the Premises to the Child/Children with reasonable care and skill.

The provision of the Services in relation to the Child/Children will normally involve the Child/Children engaging in messy play which will involve the use of equipment and allowing the Child/Children to play and to play with other children.

Kidsnest will carry out the Services,but will only do so provided you remain present at the Premises and during the provision of the Services at all times.

You agree you are responsible for supervising your Child/Children at all times during the provision of the Services, and you agree that you remain solely responsible for the control, care and safety of your Child/Children at all times whilst taking part in the Services. We specifically draw your attention to your obligations set out under the heading “Your responsibilities and obligations” below. Please read them carefully.

We do not accept any responsibility for any accident, allergic reaction or illness found to be directly attributable from any product or item provided in respect of the provision of the Services.

It is your responsibility to ensure the Child/Children do not interact with any material/food substance that may cause an allergic reaction to your Child/Children.
You must not bring drinks or food into the area where the Services are being carried out as these may present a safety hazard, other than water which must be in a sealed non-spill water bottle.
You must provide certain items on each occasion that your Child/Children use the Services, including clothing suitable for use of the Services and a change of clothing.
You must not attend the session with your Child/Children if they or you are ill. Kidsnest reserves the right to request you and your Child/Children leave the session if it you or your Child/Children are ill.
You will inform a member of staff if your Child/Children has/have had a toilet accident so the products used in the Services can be taken away to be cleaned sterilised and replaced.

Charges for the Services and payment

You can obtain our current fees via our website or by contacting Kidsnest. All fees for the Services must be paid to secure your Child/Children(s) place and must be paid before the Services will be provided. We accept payment by way of EFT and most credit cards.
If you fail to pay the amount you owe Kidsnest may refuse to provide further Services until payment is received.
If you book the Services for a period, then the charges will remain at the rate in force at the time you booked (even if Kidsnest increases its rate during the period of your booking).

Cancellation

At times Kidsnest may not be able to provide the Services. However, if the Services cannot be provided Kidsnest will at its sole discretion either provide the Services on the next available occasion and on the same day of the week that the Services would have been provided had they not been canceled or provide a full refund.
If you or the Child/Children:
1. do not comply with Kidsnest’s reasonable instructions;
2. are behaving or acting unreasonably towards Kidsnest, its employees or to other children or persons (including by not following directions); or

are causing harm or are likely to cause harm to Kidsnest or other children (including if they are unwell),

then Kidsnest may suspend the performance of the Services immediately, or no longer provide Services. In relation to this paragraph (b), due regard and allowance will be made to the age, health and capabilities of the Child/Children. If the performance of the Services are terminated or suspended in accordance with this clause, you shall not be entitled to any refund in respect of the Services.

Your responsibilities and obligations

In addition to other responsibilities and obligations you have as set out in these terms you also agree that:

Under no circumstances will you leave the premises whilst your Child/Children is/are participating in the Services, and you will closely supervise your Child/Children for the duration of the Services.

You will ensure that you and your Child/Children behave in a way to not cause harm or abuse to any other children or adult.
If you authorise another person to supervise your Child/Children whilst they are participating in the Services:
1. that person must be over the age of 18;
2. you will inform that person that they must remain at the premises and are responsible for supervising your Child/Children; and

you will notify Kidsnest before the provision of the Services, except that failure to do so will not result in a waiver of your responsibilities under these terms and conditions.

Your possessions on the Premises

Kidsnest’s premises are used by other children and the parents or carers of other children. Under no circumstances will Kidsnest or any of its employees or contractors be responsible for the loss of any of yours, or your Child/Children’s possessions whilst at the Premises or whilst using the Services.

Limitation of Liability

You acknowledge that you and your Child/Children are participating in a recreational activity that carries risks, and that you are required to sign a waiver prior to the Services.
Kidsnest takes no liability in relation to loss and or damage to your personal property brought on to the Premises. You should ensure all personal property is kept on your person at all times.
Kidsnest does not accept any responsibility whatsoever for any accident, allergic reaction or illness found to be directly attributable to a product or item provided. You are reminded that you must supervise your Child/Children at all times and ensure they do not eat or place items in their mouths, and ensure the equipment and products provided are used safely at all times by your Child/Children.
